LIVlution is a brand that sells products with original illustrations and designs, created through our artistic vision. We use an on-demand printing service for your production. So each order is distinct and individual and the production of it, is carried out after the payment of the order, after the confirmation of the same, the order and the information associated with it is redirected to our printing on demand supplier so that it can comply with and produce the products that the customer purchased on our website. When visiting our website and making purchases on it you are aware of this information, agreeing and accepting it, being aware that the production and shipping of the products of our store, is done through a printing supplier under demand.

By agreeing to these Terms and Conditions and making purchases through our website, livlution.com, you declare that you are over eighteen years old (18 ) and that you have the legal capacity to enter into contracts and browse our website.

The products available for purchase on this website, livlution.com, are exclusively for personal and never commercial use.

By visiting and shopping on our website, you understand that you can’t use our products for any illegal or unauthorized purpose or activity, nor may you, in the use of our services, violate any laws in your jurisdiction (including copyright laws). You can’t place fraudulent or false orders/orders.

LIVlution is not obliged to treat this type of Information and comments as confidential, the customer thus agrees that LIVlution may use the information, remove, disclose, distribute, translate, copy, edit and publish without any restrictions.

 

2.3 SERVICES AND PRODUCTS

 

At any time LIVlution reserves the right to modify or discontinue our website, or any part of it, without prior notice. We reserve the right to limit any services we offer, products, as well as the quantity, their discontinuation, suspension, alteration and/or modification. We reserve the right to limit sales of our products or services to any person, geographical region or jurisdiction, and may exercise this right on a case-by-case basis.

Certain products or services may be limited, either for a period of time or by exclusive online availability, and may be limited in quantity and are subject to return or exchange in accordance with our Refund and Return Policy.

LIVlution makes sure to display the colors and images of our products as accurately as possible, but we remind you that as mentioned above, that we use an on-demand printing service for the production and shipping of our products, having said that we inform you that printing is a chemical recess and it is not possible to achieve one hundred percent consistency, several factors influence the color, consistency and the final result. The color variations that may occur due to these factors are within the acceptable tolerance levels and are not covered by the quality assurance of our On-demand printing supplier. We cannot guarantee that the customer’s navigation tool displays our products or website accurately.

 

3. ORDERS, DELIVERIES AND TRANSPORTATION.

 

All orders placed on our website, livlution.com, are subject to the availability and confirmation of the supplier who produces and prints our products on demand, since LIVlution uses its services to produce and send the orders (produced after the customer places the order and his payment), and so the brand does not have a physical stock of them, and its availability is subject to the availability of the products in the local producers to which our supplier uses.

The delivery of the products ordered by the customers will be made to the address indicated by the customer, so it is the responsibility of the customer to make sure and verify that the address provided is correct as well as all the information and data related to the order.

As indicated above, we reinforce that LIVlution uses an on-demand printing supplier that produces and sends the products of the customer’s order to the same, so all shipments are made by them, delivery times may vary according to the customer’s location and the availability of the products, we are not responsible for delays, loss and/or damage, among other events related to the shipment and delivery of orders since they are not carried out by us.

 

4. REFUNDS, RETURNS AND CANCELLATIONS.

 

LIVlution, as previously referred to in these Terms and Conditions, reserves the right to cancel any order, even if it is submitted, for reasons of non-conformity, violation, incomplete or incorrect data (provided by the customer, it is his responsibility to update and verify them before submission, as well as the veracity thereof), unavailability of the product(s) of the order, among others. We will always try to contact the customer, through the data and information he provides, to give notice of the cancellation of the order, but if this is impossible due to technical failures, errors, lack of information or incomplete or wrong data, among other reasons, we reserve the right to cancel the order without prior notice (if the reason is due to non-compliance and/or violation of our Terms and Conditions and/or our Policies, we reserve the right to immediately cancel the order without prior notice)

Returns and refunds are subject to the returns and refunds policy of our print-on-demand supplier (we advise you to consult our REFUND AND RETURNS policy)

The cancellation of the order by the customer must be communicated to us within a period of twenty-four hours (24h), by the customer through the contact form or email: (create email for this type of situation). We will contact our supplier to analyze the situation and if the supplier has not started production of the product(s) if it is possible to cancel the order.

 

5. INTELLECTUAL PROPERTY

 

Our Terms and Conditions make the customer acknowledge that all intellectual property rights, author, related to our products, content, services and information provided, website and/or brand, are and will remain the property of LIVlution.

We may but have no obligation or liability for monitoring, editing or removing content that violates the Terms and Conditions, which we will determine to be illegal, offensive, threatening, defamatory, pornographic, obscene or objectionable, that violates any part of our Terms and Conditions.

 

6. CHANGES TO THE TERMS AND CONDITIONS

 

LIVlution reserves the right to change these Terms and Conditions at any time, such changes will take effect immediately after they are published on this website page.

 

7.DISCLAIMER OF UNCONTROLLED WARRANTIES AND EVENTS

 

LIVlution will not be responsible for any events beyond your control, including but not limited to technical server failures, temporary or permanent removal of our site at any time without prior notice.

LIVlution is not responsible for failures to comply with our obligations arising from events beyond our control, known as “Force Majeure”. This includes but is not limited to: natural disasters (such as fires, explosions, storms, floods, earthquakes or epidemics), civil disturbances, strikes, blockades or protests, interruptions in public or private transport, including trains, meters, planes, motor vehicles, problems with maritime, inland waterway, postal or other means of transport, failures in telecommunications systems (or general communication failure), acts of war, terrorism or threats related to them, changes in laws or government regulations.

During such Force Majeure events, our obligations under these Terms and Conditions will be suspended. We will make every reasonable effort to resolve the situation and comply with our obligations as soon as possible.

The services and all products and delivered are provided “as is” and “as available”, without warranties or conditions of any kind, express or implied. In no event shall LIVlution, administrators, employees, agents, contractors, interns, suppliers or service providers be liable for any direct, indirect, incidental, punitive, special or consequential injury, loss, claim or damages of any kind, including, without limitation, loss of profits, loss of revenue, loss of savings, loss of data, replacement costs or any perception of similar indemnification, whether based on these Terms and Conditions (including negligence), strict or other liability, arising from the use of any of our services or products.
